PoSH Act 2013: Law on Sexual Harassment at Work in India
Sexual harassment at workplaces is a violation of women’s right to work. It infringes on their right to live with dignity as well.
Consolidating various global and national laws on the issue, in December 2013, the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act came into force in India. Often referred to as the PoSH Act 2013, this was a huge reassurance to women across India working in various industries.
The law mandates that all organizations with more than 10 employees implement the provisions of the act. When employees are sexually harassed by superiors, it is also a threat to job security. Internal Complaint Committees are set-up to address issues where employees are objectified based on their gender or sexuality. Employers should stand by the victim and lend a hand in case the victim decides to take the matter to court.
The FICCI-EY November 2015 report reveals that only 64% of Indian companies and 75% among MNCs are compliant with the Posh Act 2013, following which, the government tightened up the implementation of the law.
Today, there is an increasing demand for sexual harassment prevention training among corporates. Organizations are nurturing safe and gender-equal workplace culture through their continuous efforts.
